Amazon Registry Service Terms

The following Service Terms apply only to the specific Services to which the Service Terms relate. In the event of a conflict between the terms of these Service Terms and the terms of the Amazon Registry Customer Agreement or other agreement with us governing your use of our Services (the “Agreement”), the terms and conditions of these Service Terms apply, but only to the extent of such conflict. Capitalized terms used herein but not defined herein shall have the meanings set forth in the Agreement.
1. Universal Service Terms (Applicable to All Services)
1.1. You may only use the Services to store, retrieve, query, serve, and execute Your Content that is owned, licensed or lawfully obtained by you, and Third Party Content that is licensed or lawfully owned by you. As used in these Service Terms, “Your Content” includes any “Company Content” and any “Customer Content.” As part of the Services, you may be allowed to use certain software (including related documentation) provided by us or third party licensors. This software is neither sold nor distributed to you and you may use it solely as part of the Services. You may not transfer it outside the Services without specific authorization to do so.
1.2. You must comply with the current documentation applicable to the Services (including the applicable developer guides) as posted by us and updated by us from time to time on the Amazon Registry Site. In addition, if you create technology that works with a Service, you must comply with the current documentation applicable to that Service (including any applicable developer guides) as posted by us and updated by us from time to time on the Amazon Registry Site.
1.3. You will provide information or other materials related to Your Content as reasonably requested by us to verify your compliance with the Agreement. We may monitor the external interfaces (e.g., ports) of Your Content to verify your compliance with the Agreement. You will not block or interfere with our monitoring. You will reasonably cooperate with us to identify the source of any problem with the Services that we reasonably believe may be attributable to Your Content or any end user materials that you control.
1.4. If we reasonably believe any of Your Content or Third Party Content that you are using or displaying violates the law, infringes or misappropriates the rights of any third party or otherwise violates a material term of the Agreement (including the documentation, the Service Terms, or the Acceptable Use Policy) (“Prohibited Content”), we will notify you of the Prohibited Content and may request that such content be removed from the Services or access to it be disabled. If you do not remove or disable access to the Prohibited Content within 2 business days of our notice, we may remove or disable access to the Prohibited Content or suspend the Services to the extent we are not able to remove or disable access to the Prohibited Content. Notwithstanding the foregoing, we may remove or disable access to any Prohibited Content without prior notice in connection with illegal content, where the content may disrupt or threaten the Services, pursuant to the Digital Millennium Copyright Act or as required to comply with law or any judicial, regulatory or other governmental order or request. In the event that we remove content without prior notice, we will provide prompt notice to you unless prohibited by law.
1.5. From time to time, we may offer free or discounted pricing programs covering certain usage of the Services (each, a “Special Pricing Program”). We may stop accepting new sign-ups or discontinue a Special Pricing Program at any time. Standard charges will apply after a Special Pricing Program ends or if you exceed the limitations by the Special Pricing Program. You must comply with any additional terms, restrictions, or limitations (e.g., limitations on the total amount of usage) for the Special Pricing Program as described in the offer terms for the Special Pricing Program or on the pricing page for the eligible Service(s). You may not access or use the Services in a way intended to avoid any additional terms, restrictions, or limitations (e.g., establishing multiple accounts in order to receive additional benefits under a Special Pricing Program), and we may immediately terminate your account if you do so. Any data stored or instances provided as part of a Special Pricing Program must be actively used.
1.6. If we make multiple discounts or pricing options for a Service available to you at one time, you will only be eligible to receive one discount or pricing option, and will not be entitled to cumulative discounting and pricing options.
1.7. You will ensure that all information you provide to us via the Amazon Registry Site (for instance, information provided in connection with your registration for the Services, etc.) is accurate, complete and not misleading, and you agree to maintain the accuracy and completeness of this information. You agree that we can (i) suspend or terminate your use of the Services if we suspect that the contact information you have provided is inaccurate or incomplete; and (ii) contact you about your account and the Services using the contact information you provided.
1.8. From time to time, we may apply upgrades, patches, bug fixes or other maintenance to the Service Offerings (“Maintenance”). We agree to use reasonable efforts to provide you with prior notice of any scheduled Maintenance (except for emergency Maintenance) and you agree to use reasonable efforts to comply with any Maintenance requirements that we notify you about.
2. Site Builder Service
2.1. The Amazon Registry site builder service (“SBS”) is a suite of website-building tools consisting of website templates that you select; hosting; storage; and certain images, illustrations, or photographs owned or licensed by third parties (“Images”) to create and maintain a website. You must register for SBS by logging into the Amazon Registry Site with your Amazon.com account. You agree that we can set limits for and conditions on your use of SBS.
2.2 SBS is available to you for use solely in connection with a domain name that you have registered in an Amazon Registry TLD for which we control the name servers and manage the DNS. Cancellation or expiration of the domain name registration suspends your ability to use SBS and any website you have created using it.
2.3 All content that you upload, post, transmit or otherwise make available via a website you create and maintain using SBS is Your Content, for which you are solely responsible. You acknowledge and agree that we will not be liable in any way for any of Your Content, including but not limited to, loss or damage resulting from use of Your Content posted, displayed, or transmitted via SBS. You represent and warrant that (a) you have all necessary rights to use such content; and (b) the content does not violate the intellectual property rights or other rights of any third party.
2.4 You will not modify, rent, lease, loan, sell, distribute, or create derivative works based on the Images or any Third-Party Content that is made available to you through SBS.
2.5 You acknowledge that we do not pre-screen Your Content, but that we have the right (but not the obligation) in our sole discretion to delete, refuse, or take down any of Your Content that is available through SBS. We have the right to delete, refuse, or take down any of Your Content that violates the Agreement, Acceptable Use Policy, these Service Terms, or any other Policy. You agree that you bear all risks associated with the use of Your Content.
2.6 We may preserve and/or disclose Your Content if we are required to do so by law or we have a good faith belief that preservation and/or disclosure of Your Content is reasonably necessary to comply with legal processes; enforce the Agreement, Acceptable Use Policy, Service Terms, or any other Policy; respond to claims that Your Content violates third-party rights; protect our property and rights, or the rights or personal safety of our customers.
2.7 SBS fees must be paid in advance (not billed in arrears), and are not refundable. We reserve the right to suspend your ability to use SBS and any website you have created using it, or charge you additional fees if we determine, in our sole discretion, that you are exceeding storage and/or bandwidth limits for any particular website you create and maintain using SBS. For reference, the current storage limit is 1 GB and the current bandwidth limit is 500 MB.
2.8 By submitting Your Content to us for creation of a website, you grant us a world-wide, royalty-free and non-exclusive license to copy, modify, adapt and publish Your Content within the SBS, and to reference, depict, and display your website for marketing purposes only for as long as you are an SBS customer. You represent and warrant that (a) you have all necessary rights to use such content; and (b) the content does not violate the intellectual property rights or other rights of any third party. This license terminates or is suspended when your website is terminated or suspended, respectively.
2.9 You acknowledge and agree that we may suspend or terminate your website and use of SBS if we determine, in our sole discretion, that you are remotely accessing the Service using automated methods or are using SBS for file sharing.
2.10 We reserve the right to place advertisements for products and services offered by us, our affiliates or third parties in the SBS (e.g., website templates, tools, etc.) and on any website or tool you create and maintain using the SBS.
3. Subscription Service
3.1 The Amazon Registry Subscription Service allows you to subscribe to certain Services on a monthly basis.
3.2 You may cancel your subscription any time by visiting Your Account and editing your subscription settings. We do not offer any refund if you cancel your subscription. Instead, you will be permitted to use the relevant Service until the end of the 30-day period covered by the most recent subscription payment.
3.3 We reserve the right to accept or refuse subscriptions. We may send you email and other communications related to your subscription to the Services (regardless of any settings or preferences related to your Amazon account). You may not transfer or assign your subscription or any subscription benefits, including promotion codes for subscriptions, except as allowed in these terms. From time to time, Amazon Registry may choose in its sole discretion to add or remove Services from the subscription program.
3.4 If all eligible payment methods we have on file for you for payment are declined, you must provide us a new eligible payment method promptly or your subscription will be canceled. If you provide us with a new eligible payment method and are successfully charged, your new subscription period will be based on the original renewal date and not the date of the successful charge.
3.5 UNLESS YOU NOTIFY US BEFORE A CHARGE THAT YOU WANT TO CANCEL OR DO NOT WANT TO AUTO RENEW, YOU UNDERSTAND YOUR AMAZON REGISTRY SUBSCRIPTION WILL AUTOMATICALLY CONTINUE AND YOU AUTHORIZE US (WITHOUT NOTICE TO YOU, UNLESS REQUIRED BY APPLICABLE LAW) TO COLLECT THE THEN-APPLICABLE SUBSCRIPTION FEE AND ANY TAXES, USING ANY ELIGIBLE PAYMENT METHOD WE HAVE ON RECORD FOR YOU.
3.6 We sometimes offer certain customers various trial or other promotional subscriptions, which are subject to these Service Terms except as otherwise stated in the promotional offers. Trial users may at any time (through by visiting Your Account and editing your subscription settings) choose not to elect or convert to, as applicable, a paid subscription at the end of a trial period.
3.7 We may in our discretion change any aspect of Amazon Registry’s Subscription Service without notice to you. If any change to these terms is found invalid, void, or for any reason unenforceable, that change is severable and does not affect the validity and enforceability of any remaining changes or conditions. YOUR CONTINUED SUBSCRIPTION AFTER WE CHANGE THESE TERMS CONSTITUTES YOUR ACCEPTANCE OF THE CHANGES. IF YOU DO NOT AGREE TO ANY CHANGES, YOU MUST CANCEL YOUR SUBSCRIPTION.
3.8 We may terminate your Amazon Registry Subscription Service at our discretion without notice. Except as provided in this section 3.8, you will be permitted to continue to use the Service Offering covered by the Subscription Service for the remainder of the most recent 30-day period. However, we will not give any refund for termination related to conduct that we determine, in our discretion, violates these Service Terms or any applicable law, involves fraud or misuse of the Amazon Registry Subscription Service, or is harmful to our interests or another user. Our failure to insist upon or enforce your strict compliance with these Service Terms will not constitute a waiver of any of our rights.
4. SBS Subscription Service
4.1 Amazon Registry offers customers a 14-day trial period to try the SBS at no charge (“Trial Period”). During the Trial Period, you may use the SBS tools to build a website, but you cannot publish your website (e.g., make it visible on the Internet). In order to publish your website, you must use the SBS Subscription Service and purchase a monthly subscription to SBS at the then-applicable subscription fee.
4.2 The Trial Period starts when you complete the steps necessary to register your applied-for domain name; regardless of when the domain name registration is allocated to you and activated. If you have not purchased the SBS Subscription Service by the end of the Trial Period, you will be unable to access Your Content that you contributed to the unpublished website. However, if you purchase the SBS Subscription Service within 30 days after the Trial Period ends, you will be able to access Your Content that you contributed to the then-unpublished website.
4.3 You cannot start the SBS Subscription Service until after your applied-for domain name registration is allocated to you and activated. You cannot pay the SBS subscription fee before the applied-for domain name registration is allocated to you and activated.
